Privacy Policy

1. Who we are

Tachograph AI is operated by Has Korkmaz Teknoloji Ltd. Şti., Ferhatpaşa Mah. Seyitnizam Cd. No:3 D:4, Ataşehir, Istanbul, Turkey (Küçükyalı Tax Office, tax no. 4581613976) ("we"). Contact: [email protected].

  • Account, billing and website data: we are the controller.
  • Driver, vehicle and tachograph data uploaded by customers: the customer is the controller and is responsible for having a legal basis and for informing its drivers. We process this data only on the customer's instructions, under our Data Processing Agreement. Drivers should send their requests to their employer.

Payments. Our order process is conducted by our online reseller Paddle.com. Paddle is the Merchant of Record for all our orders and processes payment data under its own privacy notice. We do not receive or store full card details.

2. Data we process

  • Account and sign-in data: name, company, e-mail, phone, role, and data received from Google or Microsoft sign-in.
  • Billing data: billing details, plan and invoices.
  • Region and time zone: the country selected from the region you enter, and the time zone set automatically from it.
  • Data in uploaded files: driver card details, driving and rest times, infringements, border crossings, GNSS positions and vehicle details.
  • AI assistant questions and answers.
  • Technical data: IP address, device, browser and logs.
  • Cookie data (Section 4) and support messages.

3. Why we process data

We process data to provide the Service and the AI assistant (contract); for billing, tax and other legal duties (legal obligation); for security, support and improving the Service (legitimate interests); and for analytics, advertising cookies and marketing e-mails (consent). These legal bases apply under the GDPR, the UK GDPR and Turkish Law No. 6698 (KVKK).

Reports and AI answers are for information only. The customer remains responsible for its decisions and for compliance with tachograph law. We do not make automated decisions with legal effects on individuals.

Anonymised data. We may anonymise personal data in line with the GDPR and the KVKK, so that it can no longer identify any individual or customer, directly or indirectly. For data we process on behalf of customers, we do this on the customer's instruction under our Terms of Service. Anonymised data is not personal data. We may use it without time limit to improve the Service, including our AI features, and for statistics, industry reports, marketing and other business purposes, and we may share it with third parties.

4. Cookies

Necessary cookies are always active. All other cookies are used only after you accept them in our cookie banner. You can change your choice at any time via "Cookie settings" at the bottom of the page.

  • Analytics: Google Analytics (Google) and Hotjar (Hotjar Ltd.).
  • Advertising: Google Ads (Google), Meta Pixel (Meta Platforms) and LinkedIn Insight Tag (LinkedIn).

5. Who we share data with

We do not sell personal data. We share it only as far as needed with Paddle, hosting providers (servers in the European Union), AI model providers, sign-in and e-mail providers, the analytics and advertising providers in Section 4, and our advisers. We may also disclose data where the law requires it, or to a buyer in a merger or sale of our business.

Some of these providers are outside the EEA, the UK or Turkey, for example in the United States. In that case we use the safeguards the law requires, such as the EU Standard Contractual Clauses and the transfer rules of the KVKK.

6. How long we keep data

We keep data while the account is active and delete it after the account is closed, as set out in our Terms of Service. Invoices and accounting records are kept as long as the law requires. Customers must export any tachograph data they are legally required to keep before closing their account.

7. Your rights

You can ask to access, correct or delete your data, to restrict or object to its use, to receive a copy of it, and to withdraw your consent at any time. Send requests to [email protected]. Requests about data uploaded by an employer are forwarded to that customer.

You can also complain to the data protection authority in your country, or to the KVKK in Turkey.

8. Security and changes

We use appropriate technical and organisational security measures. You are responsible for keeping your login details safe. We may update this policy; the version published on this page applies from its publication date.
